For parents who are married when a child is born, it is presumed that the husband is the biological father. However, for unmarried parents, there is no assumption unless the father signs a voluntary recognition of parentage in the hospital. If paternity is not established, the father does not have legal rights to visitation or custody. Likewise, without establishing paternity, a mother cannot request child support through the court.
